Refund & Cancellation Policy

We stand behind the quality of our work. This Refund & Cancellation Policy explains when refunds are available, how to request one, and how cancellations work for custom creative production services provided by Mohammed Benfarji LLC.
1. Nature of our services
We provide custom, bespoke creative production services tailored to each client’s brief. Our deliverables — videos, images, briefs, and workflows — are produced specifically for the client and are not off-the-shelf goods. As such, once production has started, substantial labour, compute, and third-party costs have already been incurred.
2. Before production begins
Before we start work on any approved Statement of Work ("SOW"):
- Full refund available. If you cancel before we begin production, you may request a full refund of any payments made. Email us within 48 hours of payment to request this.
- Acceptance of brief. Production starts when we send you written confirmation that we’re beginning work.
3. After production begins — partial refunds
Once we have started work on your project, fees are earned in proportion to work completed. If you cancel mid-project:
- We will deliver the work completed up to the cancellation date in its then-current state.
- Unearned fees (for work not yet performed) are refundable pro-rata, after deducting non-recoverable third-party costs (e.g., AI model compute, stock licenses, freelancer fees) incurred on your behalf.
- No refund is available for deliverables already approved by you in writing or used publicly by you.
4. Failure to deliver
If we materially fail to deliver the services described in your SOW on time and cannot cure the failure within fourteen (14) days of your written notice, you are entitled to a full refund of fees paid for the affected undelivered work. Contact us at contact@mohammedbenfarjillc.com with the subject line "Refund Request" and reference your SOW or invoice number.
5. Quality concerns
If you are not satisfied with a deliverable:
- Email contact@mohammedbenfarjillc.com within seven (7) days of receiving the deliverable, describing the specific concerns.
- We will review your feedback and provide revisions under the revision rounds included in your SOW (typically up to two (2) rounds, unless otherwise stated).
- If after the included revisions we are unable to deliver work that materially meets the agreed brief, we will — at our sole discretion — refund up to fifty percent (50%) of the fees for the affected deliverable.
Subjective dissatisfaction with creative direction that matches the approved brief does not constitute grounds for a refund.
6. What is non-refundable
The following fees are non-refundable once work has begun:
- Fees for deliverables already delivered and approved by the client in writing
- Fees for deliverables already used publicly by the client (e.g., published to ad accounts, social media, or distributed to third parties)
- Non-recoverable third-party costs incurred on the client’s behalf (AI compute, stock media licenses, voice licenses, paid-contractor fees)
- Rush fees, onboarding fees, and consulting retainers for time already spent
7. Monthly retainers
For monthly retainer engagements:
- Either party may terminate the retainer with thirty (30) days’ written notice.
- Fees paid for the current month are earned as of the billing date and are non-refundable, except where we have materially failed to deliver the agreed monthly scope.
- Unused creatives in a given month do not roll over to the next month unless agreed in writing.
8. How to request a refund
All refund requests must be made in writing to contact@mohammedbenfarjillc.com and include:
- Your full name and company name
- The SOW or invoice number
- The deliverable(s) in question
- A detailed description of the reason for the refund request
We aim to respond to all refund requests within five (5) business days. Approved refunds are issued to the original payment method within ten (10) business days of approval. Refunds for payments made by international wire transfer may take up to twenty (20) business days due to banking timelines.
9. Chargebacks
We take chargebacks and disputed transactions seriously. Before initiating a chargeback with your bank or card issuer, please contact us first so we can attempt to resolve the issue directly. Initiating a chargeback without first contacting us constitutes a breach of these terms and may result in collection proceedings for the disputed amount plus associated chargeback fees and reasonable attorneys’ fees.
10. Policy updates
We may update this Refund Policy from time to time. The "Last updated" date reflects the most recent version. The policy in effect at the time you make payment governs that engagement.
